Terms of Service - AwiFin

In these Terms, "AwiFin," "we," "us," or "our" means eRapid Studio operating the AwiFin service.

AwiFin is a SaaS product that helps users create, organise, generate, and share project updates and stakeholder reports.

The service may include features such as:

To use AwiFin, you may need to create an account.

You agree to provide accurate and up-to-date information and to keep your login credentials secure.

You are responsible for all activity under your account, including activity by users you invite to your workspace.

You must notify us promptly if you suspect unauthorised access to your account.

AwiFin is intended for business and professional use.

You may not use AwiFin if:

AwiFin is not directed to children.

"Customer Content" means any content, data, text, project updates, reports, stakeholder profiles, imported Jira data, Slack-related data, files, prompts, AI inputs, AI outputs, shared reports, or other materials submitted to or generated through AwiFin by you or your authorised users.

You retain ownership of your Customer Content.

You grant AwiFin a limited, non-exclusive, worldwide licence to host, process, transmit, display, copy, and use Customer Content only as necessary to provide the service, operate and secure the service, generate AI-assisted outputs requested by you, provide support, troubleshoot issues, comply with law, and enforce these Terms.

We do not sell your Customer Content.

AwiFin does not use Customer Content to train its own AI models. Where AwiFin uses OpenAI through business or API services, customer inputs and outputs are not used by OpenAI to train models by default, unless such use is explicitly enabled or separately agreed.

You must not upload or process content that you are not authorised to use.

AwiFin is not designed for processing special categories of personal data under Article 9 GDPR, such as health data, biometric data, political opinions, religious beliefs, trade union membership, or data concerning sex life or sexual orientation.

You must not submit such data to AwiFin unless you have a valid legal basis and authority to do so.

You should also avoid submitting unnecessary personal data, confidential third-party information, trade secrets, or highly sensitive business information unless such processing is necessary and authorised.

AwiFin may use artificial intelligence features to generate summaries, reports, executive snapshots, stakeholder-specific updates, blocker summaries, risk summaries, decision summaries, email drafts, Slack update drafts, and similar content.

AI-generated content may be inaccurate, incomplete, outdated, misleading, or unsuitable for a particular audience or purpose.

You are responsible for reviewing, editing, validating, and approving AI-generated content before relying on it or sharing it.

AwiFin does not provide legal, financial, medical, tax, compliance, or professional advice. You should not rely on AI-generated outputs as the sole basis for significant business, legal, financial, or operational decisions.

AwiFin may allow users to create and share reports through links. Depending on your settings, anyone with access to a shared link may be able to view the report.

You are responsible for:

We may display "Generated with AwiFin" or similar attribution on shared reports, especially for free or early-access plans.

AwiFin may integrate with third-party services such as Slack and Jira. If you enable an integration, you authorise AwiFin to access, process, and transmit data as necessary to provide that integration.

Your use of third-party services remains subject to the terms and privacy policies of those third-party providers. We are not responsible for third-party services, their availability, security, functionality, or changes.

You are responsible for ensuring that you have authority to connect third-party tools to AwiFin and to process data imported from or exported to those tools.

AwiFin may offer free, early-access, trial, or paid plans. Paid plans are processed through Stripe or another payment provider.

You agree to provide accurate billing information and authorise the payment provider to charge applicable fees, taxes, and recurring subscription amounts.

Unless stated otherwise, subscriptions renew automatically until cancelled. You may cancel your subscription according to the cancellation flow available in the service or by contacting us.

Cancellation stops future renewals but does not automatically refund previous payments unless required by law or expressly stated by us.

We may change prices or plan features with reasonable notice. Changes will not affect the current paid billing period unless required by law or agreed by you.

Some AwiFin features may be provided as early access, beta, experimental, or preview functionality. Such features may be incomplete, unstable, changed, limited, or discontinued at any time.

We may use feedback from early-access users to improve the product. You agree that early-access or beta functionality is provided "as is" and may not be suitable for production-critical use.

You must not use AwiFin to:

We may suspend or terminate access if we reasonably believe these rules are violated.

AwiFin, including its software, design, interface, branding, workflows, documentation, and related materials, is owned by eRapid Studio or its licensors. These Terms do not transfer ownership of AwiFin intellectual property to you.

You may use AwiFin only as permitted by these Terms. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on AwiFin unless expressly authorised by us.

If you provide feedback, ideas, suggestions, or feature requests, you grant us the right to use them without restriction or compensation. We may use feedback to improve AwiFin, develop new features, or modify existing features.

Our processing of personal data is described in the AwiFin Privacy Policy.

If you use AwiFin on behalf of a company or organisation and Customer Content includes personal data, the Data Processing Agreement may apply.

Where applicable, you are responsible for determining whether you are a controller and whether AwiFin acts as processor for Customer Content.

We use reasonable technical and organisational measures designed to protect the service and Customer Content. However, no online service can guarantee absolute security.

You are responsible for securing your account, managing access permissions, reviewing invited users, and protecting integration credentials.

We aim to keep AwiFin available and reliable, but we do not guarantee uninterrupted or error-free operation.

The service may be unavailable due to maintenance, updates, infrastructure issues, third-party provider outages, security incidents, or other reasons.

Support may be provided by email or other channels we make available. Unless expressly agreed in a separate written agreement, we do not provide guaranteed response times or service-level commitments.

We may change, suspend, or discontinue parts of the service at any time. Where a material change significantly affects paid users, we will make reasonable efforts to provide notice.

We are not liable for changes, suspension, or discontinuation of features, except where required by applicable law or a separate written agreement.

You may stop using AwiFin at any time. We may suspend or terminate your access if:

After termination, your right to access the service ends. We may delete Customer Content after account or workspace termination, subject to backup retention, legal obligations, and data protection requirements.

AwiFin is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that the service will be uninterrupted or error-free, that AI-generated content will be accurate or complete, that reports will meet your business or stakeholder needs, that integrations will always work, that third-party services will remain available, or that defects will be corrected immediately.

To the maximum extent permitted by law, eRapid Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, business opportunities, or business interruption.

To the maximum extent permitted by law, our total liability arising out of or relating to the service or these Terms will not exceed the amount paid by you to AwiFin in the three months before the event giving rise to the claim.

If you use a free or early-access plan, our total liability will be limited to EUR 100, to the maximum extent permitted by law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.

If you use AwiFin on behalf of a business, you agree to indemnify and hold harmless eRapid Studio from claims, damages, liabilities, costs, and expenses arising from:

AwiFin is intended for business and professional use. If you are a consumer under applicable law, nothing in these Terms limits your mandatory consumer rights.

These Terms are governed by the laws of Poland, unless mandatory consumer or data protection laws provide otherwise.

Any dispute arising from or relating to these Terms or AwiFin will be subject to the competent courts in Poland, unless mandatory law provides otherwise.

We may update these Terms from time to time. If we make material changes, we will notify registered users by email or through the service.

Continued use of AwiFin after the effective date of updated Terms means you accept the updated Terms. If you do not agree to updated Terms, you must stop using AwiFin.
